1. No Investment Advice; No Fiduciary Relationship

The Software does not constitute, contain, or provide investment advice, financial advice, tax advice, or legal advice of any kind. The Software does not assess the suitability of any crypto-asset or trading strategy for you. All trading decisions are made solely by you, based on your own research, risk tolerance, and financial situation.

The authors and publishers of the Software are not registered investment advisers, broker-dealers, commodity trading advisers, financial institutions, or licensed entities regulated by the U.S. Securities and Exchange Commission (SEC), the U.S. Commodity Futures Trading Commission (CFTC), the UK Financial Conduct Authority (FCA), the European Securities and Markets Authority (ESMA), or any other financial regulator. No fiduciary, advisory, or agency relationship is created by your use of the Software.

2. Risks of Spot Trading

• Severe price volatility: cryptocurrency prices can move 30% or more within hours
• Liquidity risk: under stressed market conditions, your orders may not fill at the expected price, or at all
• Exchange risk: exchanges may experience downtime, hacks, exit scams, asset freezes, or withdrawal halts
• Regulatory risk: your jurisdiction may ban or restrict cryptocurrency trading at any time, without notice
• Smart contract / protocol risk: the underlying blockchain may suffer bugs, exploits, or attacks

3. Specific Risks of Futures and Derivatives Trading

• Leverage amplification: at 10× leverage, a 10% adverse move triggers liquidation
• Forced liquidation: when maintenance margin is breached, positions are closed automatically and cannot be intervened
• Funding rates: holding leveraged positions over time incurs funding costs that erode capital
• Wick / extreme price events: instantaneous price spikes on the exchange can trigger unwarranted liquidations
• Counterparty / ADL risk: in stressed conditions, exchanges may engage Auto-Deleveraging mechanisms that close profitable positions
• Systemic risk: socialised loss systems on certain exchanges may be triggered by large bankruptcies, affecting your account

4. Risks of Automated Trading

• No strategy guarantees profit: every built-in strategy can lose money. Past performance is not indicative of future results. Backtest figures presented in marketing materials are illustrative only and do not represent guaranteed returns.
• Misconfiguration is catastrophic: incorrect leverage, stop-loss, or DCA parameters can wipe out an account in seconds
• Software, network, and hardware failure: crashes, outages, and device failures may prevent timely intervention
• API rate limits and latency: exchange APIs may throttle, delay, or reject requests, affecting execution
• Overfitting: a strategy that performs well on historical data may not adapt to future market regimes

5. Suitability — You Are Responsible

The authors of the Software make no suitability determination on your behalf. Before using the Software, you must independently determine:

• Whether you fully understand the characteristics of crypto-assets and derivatives
• Whether your financial circumstances permit total loss of the funds at risk
• Whether your risk appetite is consistent with the chosen strategy
• Whether the laws and regulations of your country or jurisdiction permit you to engage in such trading

If in doubt, consult an independent, qualified financial adviser, tax adviser, and legal counsel before depositing funds or activating any strategy.

6. Tax and Compliance — Your Responsibility

All gains, losses, and taxable events arising from your use of the Software are solely your responsibility to report and pay. The authors of the Software do not provide tax advice and do not report your trading data to any tax authority (except as required by law).

7. Three Iron Rules

1. Only use capital you can afford to lose in full
2. Keep futures leverage within 3×; beginners should use 1×
3. Every strategy must be backtested, then run on small real funds for at least 1 week, before scaling up

Disclaimer: CryptoTrade Swift is software, not a financial product, not a fund, and does not custody user funds. All trading takes place directly between your own exchange account and the relevant market. Any profit or loss from your use of the Software is your sole responsibility.

1. Restricted Jurisdictions

The Software is not offered or sold to persons located in, or who are residents of, the following jurisdictions:

• The Democratic People's Republic of Korea (DPRK / North Korea), Iran, Cuba, Syria, Crimea, and the Donetsk, Luhansk, Zaporizhzhia, and Kherson regions of Ukraine
• Any other country or territory subject to comprehensive sanctions administered by the U.S. Office of Foreign Assets Control (OFAC), the UN Security Council, the European Union, or HM Treasury (UK)
• Any country or territory in which trading in crypto-assets or crypto-asset derivatives is prohibited under applicable local law

2. Notice to U.S., U.K., Canadian and EU/EEA Users

The Software does not constitute the offer of any regulated financial product or service in the United States, the United Kingdom, Canada, the European Union/EEA, or any other jurisdiction. If you reside in any such jurisdiction:

• Use of the Software to trade crypto-asset derivatives may be unlawful under applicable local law (for example, the U.S. CFTC's restrictions on retail off-exchange leveraged products; the UK FCA's prohibition on the sale of crypto derivatives to retail consumers; restrictions arising under MiFID II / MiCA for EU/EEA retail investors).
• You are solely responsible for verifying the legality of using each connected exchange and each trading product in your jurisdiction.
• The authors of the Software make no representation or warranty that any particular trading activity is lawful in your location.

3. Your Representations and Warranties

By installing, accessing, purchasing, or using the Software, you represent and warrant that:

• You are at least 18 years of age and have full legal capacity to enter into a binding contract
• You are not located in, and are not a resident of, any Restricted Jurisdiction
• You are not, and are not acting on behalf of any person who is, listed on any sanctions list maintained by OFAC, the UN, the EU, HM Treasury, or comparable authority
• The funds you use for trading are derived from lawful sources and are not proceeds of money laundering, terrorist financing, or any unlawful activity
• You will comply with all laws and regulations of your jurisdiction, including laws governing crypto-assets, derivatives, taxation, and capital controls

1. What We Collect

CryptoTrade Swift is a local-first desktop application. The following data is processed entirely on your device and is never uploaded to any server:

• Exchange API keys and secrets (encrypted at rest with AES-GCM + PBKDF2 in your local SQLite)
• Strategy configurations, order history, backtest data, and positions
• Trading pairs, price feeds, and account balances

The Software communicates with our servers only in the following cases:

• Licence activation and verification: your licence key, a device fingerprint (hashed machine ID), and your IP address (for anti-fraud purposes) are transmitted to our licence server
• Auto-update check: version metadata latest.yml is fetched from Cloudflare R2 (no user data is transmitted)
• Error diagnostics: anonymised error logs are uploaded only when you click "Submit feedback"

The limited personal data described above is processed by:

3. Legal Bases for Processing (GDPR Article 6)

• Performance of a contract (Art. 6(1)(b)): for licence activation and software delivery
• Legitimate interests (Art. 6(1)(f)): for fraud prevention via device fingerprinting
• Consent (Art. 6(1)(a)): for diagnostic uploads, given when you click "Submit feedback"
• Legal obligation (Art. 6(1)(c)): where required by applicable law

4. Your Rights

Regardless of your location, you have the following rights with respect to your personal data:

• Right of access: request a copy of the personal data we hold about you
• Right to rectification: ask us to correct inaccurate data
• Right to erasure ("right to be forgotten"): ask us to delete your data
• Right to restriction of processing
• Right to data portability: receive your data in a machine-readable format
• Right to object to our processing of your data
• Right to withdraw consent at any time, where processing is based on consent
• Right to lodge a complaint with a supervisory authority. If you are in the EU/EEA, you may complain to your local Data Protection Authority. If you are in the UK, you may complain to the Information Commissioner's Office (ICO)

To exercise any of these rights, contact privacy@cryptotradeswift.com. We will respond within 30 days, in accordance with applicable law.

5. International Data Transfers

Our licence server is hosted in Hong Kong and the United States (via the Cloudflare network). If you are in the EU/EEA or the UK, the minimal data described above (licence key, device fingerprint, IP) is transferred outside the EEA/UK. We rely on appropriate safeguards including the European Commission's Standard Contractual Clauses (where applicable) and TLS 1.3 encryption in transit.

6. Data Retention

Licence activation records are retained for the duration of your licence + 6 months, then automatically deleted. Error logs are automatically deleted after 90 days. You may request earlier deletion via your erasure right above.

7. What We Do Not Collect

• We do not collect your trading strategies, positions, or P&L
• We do not collect your API keys or exchange balances
• We do not perform background telemetry, behavioural tracking, advertising profiling, or sale of personal data

8. Third Parties

The Software connects directly to the exchanges you configure (OKX, Binance, etc.). Such communication is governed by each exchange's own privacy policy. We do not participate in, proxy, or store data from those connections.

We use Cloudflare for content delivery and licence-server hosting. Cloudflare may process technical metadata (IP, request headers) under its own privacy policy, available at cloudflare.com/privacypolicy.

This website uses only essential cookies / localStorage to:

• Remember your language preference (zh / EN)
• Remember that you have acknowledged the risk disclosure, to avoid repeated banners

We do not use:

• Analytics cookies (e.g. Google Analytics)
• Advertising cookies
• Cross-site tracking cookies
• Third-party profiling cookies

You may reset your preferences at any time by clearing localStorage / cookies in your browser. Because the cookies we use are strictly necessary for the operation of the site, prior opt-in consent is generally not required under GDPR / ePrivacy, but we still display an informational banner on first visit.

1. Nature of the Software

CryptoTrade Swift (the "Software") is a desktop automation tool for cryptocurrency trading. The Software solely executes user-defined trading strategies and does not provide investment advice, market predictions, profit guarantees, or financial consulting.

2. User Responsibility

You acknowledge and agree that:

• All trading instructions issued through the Software are your own decisions and your sole responsibility
• You have fully understood the risks of cryptocurrency markets and futures trading prior to use
• You have the financial knowledge and risk tolerance required for such activity
• You have read and accepted in full the Risk Disclosure and Geographic Restrictions

3. Limitation of Liability

To the maximum extent permitted by applicable law, the authors and publishers of the Software disclaim all liability for:

• Trading losses arising from strategy execution, misconfigured parameters, or user error
• Losses caused by network failure, power loss, device failure, or exchange API anomalies
• Losses arising from cryptocurrency price volatility, illiquidity, or forced liquidation
• Losses caused by third-party (exchange, payment provider) service disruption
• Indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption

The aggregate liability of the authors of the Software, whether in contract, tort (including negligence), or otherwise, shall not exceed the total amount you paid for the Software in the twelve (12) months preceding the event giving rise to the claim. Some jurisdictions do not allow the exclusion or limitation of certain damages; in such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

4. Licence Grant

Purchase of a licence key grants you a non-exclusive, non-transferable right to use the Software on a single device. Licences are non-resellable; 2 free device transfers are provided per calendar year. Piracy, cracking, reverse engineering, decompilation, or removal of any digital rights management measures will result in immediate licence termination and may give rise to civil and criminal liability.

5. Refunds and Right of Withdrawal (EU/EEA Consumers)

Full refund within 7 days of purchase, prior to activation. After activation, no refunds are available for the remaining licence term.

If you are a consumer in the EU/EEA, you have a statutory 14-day right of withdrawal under the Consumer Rights Directive (2011/83/EU). However, by purchasing the Software and clicking "Activate" or otherwise initiating the digital download, you expressly consent to immediate performance and acknowledge that your right of withdrawal is thereby lost in accordance with Article 16(m) of the Directive. Trial versions do not involve a purchase and are not subject to refund.

6. Termination

If you violate these Terms, we may terminate your licence immediately. Upon termination, the Software enters a read-only mode; you may still export your local data but may not execute new trades.

7. Indemnification

You agree to indemnify, defend, and hold harmless the authors of the Software, their affiliates, employees, and agents from and against any and all claims, liabilities, losses, damages, costs, and expenses (including reasonable legal fees) arising from: (a) your breach of these Terms; (b) your violation of any applicable law; (c) third-party claims arising from your trading activities; (d) your gross negligence or wilful misconduct.

8. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict-of-laws principles. Any dispute, controversy, or claim arising out of or relating to these Terms shall first be submitted to good-faith negotiation. Failing resolution, the dispute shall be referred to and finally resolved by arbitration administered by the Hong Kong International Arbitration Centre (HKIAC) in accordance with its rules.

Nothing in this clause limits the rights of EU/EEA or UK consumers under the mandatory consumer-protection laws of their place of habitual residence. EU/EEA consumers may also access the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

9. Trademarks and Third-Party Services

"OKX," "Binance," and other exchange names are trademarks of their respective owners. The Software is not affiliated with, endorsed by, or sponsored by any of the exchanges to which it connects. Open-source components used in the Software (Electron, Vue, SQLite, etc.) are licensed under their respective licences; full attributions are available in the Software's About panel.

10. Force Majeure

The authors of the Software shall not be liable for any failure or delay in performance caused by circumstances beyond their reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, government action, internet or power outages, exchange-side downtime, or pandemics.

11. Severability and Entire Agreement

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. These Terms, together with the Privacy Policy, Cookie Policy, Risk Disclosure, and Geographic Restrictions, constitute the entire agreement between you and the authors of the Software with respect to its subject matter, and supersede all prior or contemporaneous communications.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via the Software or this website at least 30 days before they take effect. Your continued use of the Software after the effective date constitutes acceptance of the revised Terms.

In compliance with §5 of the German Telemediengesetz (TMG), §5 of the Austrian E-Commerce Act (ECG), and similar provider-identification requirements in other EU jurisdictions:
